Terms of Use

1. Scope and parties
(1) These Terms of Use (the "Terms") govern your use of the iOS application Journary and its related services (together, the "App"), provided by Pascal Lindenau, Forddamm 7, 12107 Berlin, Germany (the "Provider," "we," or "us").
(2) By downloading, installing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.
(3) The App is offered to consumers and may also be used by businesses, provided these Terms are observed.
2. What the App does
(1) Journary is a privacy-first, on-device location-history journal for iPhone. It automatically captures your location in the background, detects journeys, visualizes your history on Apple Maps, can enrich days with Apple Health statistics, supports daily journals and a home-screen widget, exports your data (GPX/KML/JSON), and turns journeys into shareable videos.
(2) All of your data is stored on your device and synced only through your own private iCloud (Apple CloudKit) under your Apple ID. We operate no servers that store your personal content, and we do not access it. See our Privacy Policy for details.
(3) The App relies on Apple platform services (including iCloud, HealthKit, notifications, and the App Store). Their availability and behavior are governed by Apple and are outside our control.
3. License to use the App
(1) We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices that you own or control, in accordance with these Terms and the Apple Media Services / App Store Terms.
(2) You may not copy, modify, reverse-engineer, decompile, resell, or sublicense the App except to the extent such restriction is prohibited by applicable law.
4. Free tier and Journary Pro (in-app purchase)
(1) The App is free to download and use. The free tier includes automatic location capture (approximately every two hours), image export, and data export.
(2) Journary Pro is an optional one-time purchase of $29.99 — a lifetime unlock, not a subscription. Pro adds high-frequency location capture (an interval from one minute to 24 hours) and video export with all render modes (user-centric and map-centric) and aspect ratios (square, portrait, landscape).
(3) The Pro purchase is sold and processed by Apple through the App Store and StoreKit. Apple is your contractual counterparty for the payment, handles all billing, and provides your receipt. We never receive or store your payment data. You can restore a previous Pro purchase on your devices through the App, using your Apple ID.
(4) Prices are shown in the App before purchase and may vary by region and over time. Local taxes are handled by Apple.
5. Your responsibilities
(1) You are responsible for using the App lawfully and for the content you create in it.
(2) You are responsible for keeping your device and Apple ID secure, and for managing your own backups. Because your data lives on your device and in your iCloud, you alone control it. We recommend keeping iCloud enabled so your history can be restored if your device is lost or replaced.
(3) If you use the App while traveling — for example to record driving trips — you must do so safely and in compliance with all applicable laws. Do not interact with the App while operating a vehicle.
(4) You grant the App device permissions (location, motion, Health, photos, notifications) voluntarily, and you may revoke them at any time in iOS Settings.
6. Availability and changes
(1) We aim to keep the App working reliably but do not guarantee uninterrupted or error-free operation, particularly where Apple platform services or your device configuration are involved.
(2) We may update, change, or discontinue features of the App over time. Where a feature you paid for (Pro) is materially affected, we will act in good faith and in accordance with applicable consumer protection law.
7. Warranty disclaimer
(1) To the maximum extent permitted by applicable law, the App is provided "as is" and "as available," without warranties of any kind, whether express or implied. In particular, location capture, trip detection, transport-mode classification, and Health-based statistics are estimates and may be inaccurate or incomplete; you should not rely on them for any safety-critical, legal, navigational, or medical purpose.
(2) Nothing in these Terms excludes or limits any statutory warranty or consumer rights that cannot be excluded under the law applicable to you, including mandatory consumer protection rights under German and EU law.
8. Liability
(1) We are liable without limitation for damages arising from injury to life, body, or health caused by our breach of duty, and for damages caused intentionally or by gross negligence, as well as under the mandatory provisions of the German Product Liability Act (Produkthaftungsgesetz).
(2) For slight negligence, we are liable only for the breach of a material contractual obligation (an obligation whose fulfilment is essential to the proper performance of the contract and on which you may regularly rely), and in such cases liability is limited to the foreseeable damage typical for this type of contract.
(3) Any further liability is excluded to the extent permitted by law.
(4) The above limitations apply accordingly to our legal representatives and vicarious agents.
9. Refunds and cancellation
(1) Because the Pro purchase is sold by Apple, refunds are handled by Apple under the App Store / Apple Media Services Terms. You can request a refund directly from Apple via reportaproblem.apple.com.
(2) Your statutory right of withdrawal for digital purchases is described in our Right of Withdrawal notice.
10. Governing law and jurisdiction
(1) These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer with habitual residence in the EU, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of residence.
(2) To the extent permitted by law, the place of jurisdiction is Berlin, Germany.
(3) We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
11. Apple as third-party beneficiary
Where the App is obtained through Apple's App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. Your use of the App must also comply with the applicable Apple Media Services Terms and Conditions.
12. Severability and contact
(1) If any provision of these Terms is or becomes invalid, the validity of the remaining provisions remains unaffected.
